Parental abduction is a form of kidnapping and can be prosecuted as such. Sometimes parental abduction happens because a custodial or non-custodial parent doesn’t know that the law requires the other parent’s written consent for his or her taking the child/ren out of state. Recently in the news, Britney Spears was chided by opposing counsel for taking her children to Las Vegas (out of their home state of California) without notifying their father. No charges were filed. There was most likely no intent to kidnap the children as the travel was on Britney’s court ordered custody time.

When parents take the children out of state on the other parent’s custody time, there is most likely foul play intended.

In divorce and non-marital battles between parents, children often become the pawns and are used by one parent to hurt the other parent.
